Terms and conditions

The Legal Notice published on this website identifies the owner in accordance with Article 10 of the Law on Information Society Services and Electronic Commerce and contains information on the personal data protection policy.

The products offered on this page are intended for consumer use. Therefore, the purchase contract is concluded upon the customer's express confirmation of their order. For this reason, 461 DIDINSKY SL recommends reading the legal notice and these general conditions in full before accepting the order.

This contract is entered into within the legal framework established for Electronic Commerce by Law 34/2002 on Information Society Services and Electronic Commerce, taking into account Law 7/1996, of January 15, on the regulation of retail trade, Law 7/1998, of April 13, on general contracting conditions, Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and Law 3/2014, of March 27.

The contracting conditions are as follows:

1. Validity of the General Conditions of Contract

The Seller's deliveries, services, and offers are carried out exclusively under these General Terms and Conditions, even if the offer is not accessed from Germany. The Seller does not, under any circumstances, accept conditions that are not included in the General Terms and Conditions or that deviate from them. General Terms and Conditions of the Customer that conflict with the General Terms and Conditions established by the Seller will only be considered as the basis for the contract if the Seller expresses its agreement with these Customer Terms and Conditions, both verbally and in writing.

2. Perfection of the contract

2.1 All merchandise offers presented by the Seller online, and information regarding their prices, are non-binding and non-binding. All prices appearing on the website include statutory taxes and other applicable costs, such as shipping costs.

2.2 The Seller reserves the right to make price changes. The Seller reserves the right to allow errors of any kind, including printing errors, technical errors, color errors, price changes, etc., despite every effort to prevent them. The Seller reserves the right to reject orders whose receipt has already been confirmed in accordance with the provisions of section 2.4. The Seller is not responsible for the accuracy of the manufacturer's information.

2.3 By ordering goods, the Consumer expresses his or her binding intention to purchase the goods ordered.

2.4 The contract is official once confirmation that the order has been registered is sent.

2.5 If, once the contract has been formalized, and despite having established the replenishment contract in due time, our suppliers do not have the requested goods within a short period of time, we reserve the right to withdraw from the contract. If this occurs, we will inform you immediately and, if applicable, refund the amount paid.

3. Property rights

3.1 The goods remain the property of the Seller until the full amount has been paid. Resale, transfer of security, transformation, rental, pawning, or any other disposal or modification without the Seller's express authorization is prohibited.

3.2 The Seller reserves the right to terminate the contract and delay delivery of the goods if the Customer fails to comply with the contract, in particular if the Customer is late in payment or fails to comply with the obligations set out in section 3.1.

4. Delivery, shipment and transfer of risk

4.1 If the goods are available, the Seller will ship them as quickly as possible, i.e., within 1 to 14 business days. If the goods are not in stock, the Seller will ship them as soon as possible, depending on the manufacturer's availability. The delivery time is subject to the Seller's availability of the goods, which in turn depends on the manufacturer's proper and timely delivery of the goods. In special and isolated cases, the delivery time may be delayed by a maximum of 4 weeks.

4.2 Binding delivery times must be agreed in writing.

4.3 If delivery is impossible for reasons beyond the Seller's control, the contract shall be deemed fulfilled once the Customer has been informed that the goods have been placed at their disposal. The delivery period may be delayed in the event of force majeure, transport or operational problems, strikes, shortages of raw materials, or similar. If the delay extends beyond four weeks from the date of conclusion of the contract, either party reserves the right to terminate the contract.

4.4 If the requested goods are not available, the Seller reserves the right to make partial deliveries, assuming the costs derived therefrom, provided that the Consumer expresses his/her consent to this.

4.5 Shipping costs are those stated on the invoice according to the carrier/courier. In the event of a return of the goods (Art. 44 of the Retail Trade Regulation Act), shipping costs will be borne by the customer, along with handling fees.

4.6 Merchandise shipments are made daily, Monday through Friday, with the address always being agreed upon with the customer. The transportation of the products will be as stated in the order and includes delivery to the customer's address. In the event of damage due to transport, the customer must note this on the carrier's delivery note. Claims for damage caused by transport will not be accepted after 24 hours from receipt and delivery of the merchandise. Upon delivery of the merchandise, the customer will receive the corresponding delivery note.

5. Warranty

5.1 If the shipment is incomplete or its characteristics do not correspond to those guaranteed, or if, within the warranty period, the merchandise shows manufacturing defects or breakages that do not imply misuse of the product, the Seller will replace it with identical or similar glasses, subject to availability, with a 5-day return period. The Seller may refuse to replace or repair the product if it would entail a disproportionate cost.

5.2 The warranty period begins on the date of delivery and is valid for 2 years.

5.3 Once the Seller has received the goods, he will reimburse the Consumer the purchase price as agreed.

5.4 Any complaint must be made in writing (by email, fax, or letter) and addressed to the Seller. If possible, it should be made immediately after the error is discovered.

5.5 Visible defects in the goods must be reported to the Seller immediately upon discovery to prevent further deterioration. Failure to report defects in the goods in a timely manner will not affect the extent of the Seller's warranty obligation. Defective goods must be sent to the Seller in the condition they were in at the time the defect was discovered, so that the Seller can examine them.

6. Limitation of liability

The Seller declines any liability arising from breaches of obligations due to slight negligence, provided that the damage does not pose a physical or health hazard or is not covered by the Product Liability Act. Furthermore, liability is excluded for breaches of obligations whose fulfillment is established from the moment the contract comes into effect and which the customer is obliged to fulfill. This same condition applies to breaches of obligations by its vicarious agents.

7. Product features, prices and language

7.1 The characteristics of the products offered on this site appear on the screen along with their visual identification.

7.2 The prices in force on the Website at the time the order is placed will apply. The price of the products is detailed below each product. VAT is included.

8 Steps to follow to place orders

8.1 You must select the items you are interested in, specifying the number of units and clicking the "Add to Cart" button to add them to your shopping cart. At any time, you can view the contents of your shopping cart, where you will see the selected items, their price, taxes, and shipping costs. From this same window, before submitting your order, you can correct, change, or cancel the selected products.
When you have finished choosing products, click the “Checkout” option.
If you are a registered user, you will need to provide your credentials; otherwise, you will need to provide your email address and personal information.
Once you have confirmed your details, you must accept the Legal Notice and General Purchase Conditions.
As a final step, you'll need to select your payment method and be redirected to the payment gateway.
Once the process is complete, you will receive confirmation of your purchase.

8.2 Order tracking:
Once the order is placed, it will be archived so that it can be accessed online until it is delivered.

8.3 Confirmation of Receipt of the Order
Each time the company receives an order, a confirmation email is sent within 24 hours of receipt, except in the case of orders received on holidays or weekends, in which case confirmation will be sent the next business day after receipt.

9. Payment

9.1 The Seller reserves the right to exclude certain payment methods for the Consumer. This condition applies especially to first-time orders or orders for which the Consumer's solvency cannot be guaranteed, whether placed from Germany or other countries.

9.2 The Seller has the right to claim unpaid payments from the consumer.

9.3 The Consumer is only entitled to compensation if the Seller acknowledges in writing that the counterclaim is undisputed or legally valid. The Consumer may only exercise his or her right of retention if the rights arise in connection with the contract itself.

9.4 Taking into account the limitations set out in section 7.1, the Consumer has the right to choose between the following payment methods:

Payment by credit or debit card . Visa, Visa Debit, Visa Electron, MasterCard. Customers can choose to pay by credit or debit card, with the transaction confirmed at the time the order is placed.

  1. The customer can pay through the PayPal gateway by validating their PayPal account.

9.5 If the Consumer is late in payment, interest of 5% above the current interest rate will be added to the purchase price. The Seller reserves the right to claim and apply damages for late payment.

10. Right of withdrawal from products (return)

Pursuant to Article 71 of Royal Legislative Decree 1/2007 of the General Law for the Protection of Consumers and Users, the buyer may return the goods within fourteen calendar days of receiving them in the same condition as when they were delivered.

The consumer must inform us of any non-conformity of the product within 30 days of receipt by emailing customer@didinsky.com , indicating that they wish to return or exchange the product. We will then arrange the return (and shipping) in the most suitable manner. Except in the case of a defective product, the consumer will be responsible for any additional costs incurred in the return.

If your order arrives with any defects, please report them immediately upon receipt. Contact our customer service team at customer@didinsky.com and we will provide you with the steps to replace the product.

To properly return products, you must follow these guidelines:

•Products must be returned in their original packaging/labels. Fragile items must be returned in bubble wrap; otherwise, the exchange and/or refund will not be processed.

•The products cannot have been used.

•Products must be accompanied by a delivery note with the reason for the return manually noted for proper and rapid return processing.

Upon arrival at our warehouse, the condition of the products will be assessed. If they do not meet the established return regulations and are in poor condition, we reserve the right to refund a lower amount for the damaged product(s).

Upon completion of the product review, the product will be exchanged or refunded through the same channel used to make the payment. If a defective product is exchanged, it may be for the same model (if stock is not exhausted) or for another product of equal or higher value (paying only the difference). We will contact you to arrange a replacement for the affected products.

Order cancellations and returns of goods will not be accepted outside the indicated deadlines.

11. Data Protection and Privacy Policy

In compliance with Organic Law 15/1999, of December 13, on the Protection of Personal Data and its implementing regulations, you are hereby informed that the personal data you provide will be incorporated into an automated file owned and operated by 461 DIDINSKY SL, for the purpose of providing you with the requested information about our products.

By completing forms on the website, by sending emails or any other type of information request sent to 461 DIDINSKY SL, the interested party gives their express consent for the processing of their personal data and to receive commercial communications about 461 DIDINSKY SL products.

Under no circumstances will 461 DIDINSKY SL use the personal data of interested parties for purposes other than those mentioned above, and undertakes to maintain due professional secrecy and to establish the necessary technical and organizational measures to safeguard the information in accordance with the requirements established by RD 1720/2007, implementing the LOPD.
